According to ABC radio news, President Obama has decided not to take action on amnesty for illegal aliens (“immigration reform” in Left euphemism) until after the 2014 election. Of course, the reason he decided to wait was because some Democrat Senators up for reelection this year are scared silly that they will lose the election if MORE amnesty is implemented before the election. They think the American voter is TOO STUPID to realize there is no difference whether an illegal act is implemented before or after an election. It is still an illegal act that will do great harm to America!

Congressman Randy Neugebauer sends out a newsletter by e-mail. I received the latest one dated October 20, 2014. The first article in the newsletter stated the following:
“Fighting Against Federal Overregulation of Texas Waters
You may remember this last spring when the EPA proposed a rule to expand their jurisdiction under the Clean Water Act of 1972. The law lets them regulate ‘navigable waters of the United States,’ but their proposed rule would expand that to include even runoff ditches and stock ponds on our private property. And for us in Texas, that means severe limits on farming, ranching, and construction. That means more top-down federal regulation that ignores local efforts.
I’ve been fighting this rule. I told you about my vote last month to prevent this EPA power-grab. It passed the House, but the Democratic-led Senate hasn’t even looked at the bill. The American people deserve better.
Last week, the Abilene Chamber of Commerce reviewed the rule and submitted their comment to the EPA in opposition. I applaud the Abilene Chamber for voicing their concerns and doing what is best for our local community.
And you can share your opinion too. EPA recently extended the rule’s comment period through November 14th, meaning they can’t finalize the rule until they’ve seen more input. You can submit your comment here.”
It also means the new proposed rules won’t be finalized until after the November 4th election. Is that planned to try to protect vulnerable Democrat incumbents and those seeking to be elected for the first time?
In the mean time, Heritage Foundation sent a questionnaire to me. One of the questions deals with which Departments of the federal government might be unconstitutional and should, therefore, be shutdown. The question listed six possible choices and asked for others. I selected all six offered and added two more.
United States Departments
* Should be part of the federal government as provided by the Constitution. All others should not be. Below are a list of the various Departments and when the Department came into being. Note the Department of Defense is basically a name change. It began as the Department of War in 1789 along with the other original Departments.

*15) Homeland Security 2002
I propose that Congress begins the process of dissolving those Departments which are not provided for by the Constitution. The Departments should be removed in reverse order of when created. Also, two agencies that have become rogue agencies be disbanded within a year. Those two agencies are:
1) Environmental Protection Agency (EPA)—½ budget to close down and the next year gone
2) Occupational Safety and Health Administration (OSHA)—½ budget to close down and the next year gone
In fiscal year 2015, the EPA receives ½ of its budget from the base year budget of fiscal year 2012. That money is to be used to close down the agency by the end of the fiscal year. In the 2016 fiscal year, there will be no EPA.
In fiscal year 2015, OSHA receives ½ of its budget from the base year budget of fiscal year 2012. That money is to be used to close down the agency by the end of the fiscal year. In the 2016 fiscal year, there will be no OSHA.
The first three Departments to be ended:
Education | 50% of budget first fiscal year
Energy | 25% of budget second fiscal year
Transportation | 25% of budget third fiscal year
In each case in fiscal year 2015, the Departments receive ½ of its budget from the base year budget of fiscal year 2012. In fiscal year 2016, the Departments receive 25% of its budget from the base year budget of fiscal year 2012. In fiscal year 2017, the Departments receive 25% of its budget from the base year budget of fiscal year 2012 which closes out the Department by the end of the 2017 fiscal year.
All other Department budgets are frozen at fiscal year 2012 levels except for the Departments of Defense, State, and Treasury
The next three Departments to be ended:
Housing and Urban Development
Health and Human Services
Labor
In each case in fiscal year 2016, the Departments receive ½ of its budget from the base year budget of fiscal year 2012. In fiscal year 2017, the Departments receive 25% of its budget from the base year budget of fiscal year 2012. In fiscal year 2018, the Departments receive 25% of its budget from the base year budget of fiscal year 2012 which closes out the Department by the end of the 2018 fiscal year.
The last two Departments to be ended:
Commerce
Agriculture
In each case in fiscal year 2017, the Departments receive ½ of its budget from the base year budget of fiscal year 2012. In fiscal year 2018, the Departments receive 25% of its budget from the base year budget of fiscal year 2012. In fiscal year 2019, the Departments receive 25% of its budget from the base year budget of fiscal year 2012 which closes out the Department by the end of the 2019 fiscal year.
If Congress chooses to do so, Congress may create a Department of Interstate Commerce based upon the power granted to it under Section 8 of Article I and only upon that power.

After I became a write-in candidate for Texas Congressional District 19, I sent information about me to both the Abilene Reporter-News and the Lubbock Avalanche-Journal. What follows are questions I received from the Abilene Reporter-News and my answers to those questions.

We received your letter announcing your congressional candidacy several weeks ago. Editorially, we wrote that Mr. Neugebauer now faces 3 opponents Nov. 4. With early voting starting Oct. 20, we need to put forth information to the public on all 4 candidates. We have background on you but here are a few more personal questions. We also are assembling 5-6 more generals questions to be submitted to all District 19 candidates. The questions will be identical.
1) You have lived in Arizona and Illinois. What brought you to Abilene and how long ago? That is relevant in forming an opinion about the incumbent.
My answer: “I moved to Abilene for a number of reasons. When I decided to move from Illinois, I could have moved anywhere in the nation. I wanted a warm weather climate. I wanted a conservative State. I wanted a State that could resist the financial temptations the federal government uses to induce States to relinquish more and more of their sovereignty. And hopefully a State that would reassert itself and insist that its sovereignty be honored. I also wanted a university within the area and possibly a military base. I have watched the Obama Administration, over the last five years, as it has worked to fundamentally transform our military. The choice came down to Tucson or Abilene. Abilene had the advantage of being much more conservative than Tucson and having three Christian oriented universities.
Abilene won out because I believe Texas is in a far better position to regain its sovereignty than Arizona. I was also impressed with Senator Cruz’s Senate victory in 2012. It told me that the conservative voters in Texas were willing to support an excellent conservative candidate over the heir apparent. Senator Cruz also has an understanding of the Constitution that most members of Congress do not have. I arrived in Abilene June 4, 2013.
When I moved here, I knew nothing of the Congressional District or of our current Congressman. It only took his primary to tell me what I needed to know. In my opinion, he is not going to challenge the current weak Republican leadership in the House of Representatives. Until the House of Representatives is willing to use the constitutional powers given to it to rein in a rogue President, I don’t believe the President will stop his lawlessness.”
2) If one of your objectives is to impeach Obama but you are setting yourself up the president will be gone by then. Is your statement that Obama should be impeached more important than reality that is may be a moot point?
My answer: “He should be impeached now. Realistically, it would take an absolute miracle to win at this late date. However, running now may alter Congressman Neugebauer’s willingness to challenge the Speaker. When I ran for the County Board of Supervisors, we had one public debate. In that debate, I said the county should develop a program to pave our many dirt roads within the county. I gave as an example a dirt road that ran past the elementary school that we had just built. Miraculously, about two weeks before the election, that dirt road was paved. Those in power will do things not planned in order to stay in power.
I don’t think our Congressman will challenge the Speaker. However, I’m laying down a challenge to him to do the right thing. The right thing is to impeach the President. In 2016, if the President has not been removed from office, one of my main issues will be to render all of his illegal actions null and void.”
3) Are issues such as abortion and same-sex marriage important enough to American people that they would elect a candidate who strongly holds to those views as major platforms? What has led you to be such an advocate on these issues?
My answer: “They should be. I belief the moral character of a nation is an important ingredient in the success of that nation. (Proverbs 14: 34) “Righteousness exalts a nation, but sin condemns any people.” Historically, major world powers disintegrate internally before externally. Abraham Lincoln has been credited as saying, “America will never be destroyed from the outside. If we falter and lose our freedoms, it will be because we destroyed ourselves.”
I believe this is a perilous time. We are in an ideological war. One side supports an all powerful national government contrary to the Constitution. The other, which includes me, supports a federal system as established by the Constitution. A system that encourages God established morality, personal liberty and responsibility, respect for the law, and free enterprise. I believe we can not heal as a nation until we stop murdering our own unborn children. The Democrat Party left me because of its obsession in support of murdering our own children. It is my responsibility as a candidate to demonstrate the correctness of my position.”
4) At the core, is state sovereignty the bigger issue?
My answer: “I think it is impossible to adequately separate each aspect of the whole. There are so many aspects that are all interrelated. Certainly, State sovereignty is an important ingredient. Texas is unique in that she was sovereign before joining the union as, of course, were the thirteen original States. Mark Levin talks of us being in the post-constitutional era. I’m more optimistic. However, we may be approaching that period if there is not a turn around soon.”
5) You have asked that an interview be conducted by e-mail—have you made public appearances? The job of congressman would be public yet your campaign seems very low key? How are you campaigning?
My answer: “My first priority is to help get as many social, fiscal conservatives elected to Congress as we can in 2014. That is of more immediate importance than my running. I believe we need to start campaigning in 2015 for 2016 and I will. This election gives me an opportunity to begin a little earlier than most candidates. I’m working to build a staff and begin the process of raising money.
I post five blogs six days a week. In a normal day, I am dealing with that for twelve or more hours. That leaves no time for me to campaign as normally understood. When I ran for office in the 1980s, I personally collected my nominating petitions. I enjoyed talking to the citizens and discussing issues one on one. I can’t do that this time but I will be active early for 2016 even as this election has ended. (An opponent once described me as a bulldog who gets ahold of something and won’t let go. I don’t disagree.)
I know it is unorthodox and it wasn’t planned. I tried to find an acceptable candidate who was willing to run in 2016. I couldn’t find one who was willing to run against an incumbent. I’ve never had that problem. I understand this certainty. You can not win if you do not run.”

My answer: “I’m afraid I don’t have time. I’m including a photo which was used by the Lubbock Avalanche-Journal newspaper in its short article about me. In the 2016 campaign, I will be more traditional since I won’t be involved in other campaigns so much.

1) Say Congress, and most people say “gridlock.” Americans consider the current Congress a “do-nothing Congress.” Overall approval ratings are at historic lows yet many in Congress are re-elected by wide margins. Some say the fault lies with a divided nation, that those in Congress are only voting for their hard-line constituents. Others say those in office won’t risk being voted out by working with or crediting the other side. What will it take to end gridlock?
My answer: This may be a surprising answer. In many ways the Constitution was written to create gridlock. In school, it is referred to as our “System of Checks and Balances.” Many of the Founding Fathers distrusted a strong centralized national government. For the most part, the fight over adopting the Constitution was whether or not it gave too much power to the federal government rather than not having enough power. It has been said that a republican form of government is a messy, slow moving, sometimes chaotic government.
A tyrannical one party government will end gridlock. I do not favor such a government. I hope and pray our citizens do not favor such a government. In a republic, with competing ideas and passions, some gridlock is inevitable and I think desirable. It is a recurring clash of competing ideas and values—differing ideologies.
2) Are you for or against term limits, and why?
My answer: I am absolutely against term limits. Elections are the best method for term limiting a member of Congress. Otherwise, voters tend to get politically lazy relying on the term limit to do what they should be doing—being discerning with their vote. Then, they tend to elect the same kind of Congressman as the one term limited.
Furthermore, it restricts the choices of the voter. If the current Congressman is his choice for the office, he should have the opportunity to vote for him. President Obama is term limited. How well is that working? He is not concerned about being reelected and he is more lawless than in his first term. He told us it would happen whispering to the Russian representative that he would have more flexibility in his second term.
3) What should be America’s role in foreign lands—from humanitarian efforts to civil wars? What should our role be in stopping terrorists?
My answer: We become involved when it is in our national interest to be involved. We can neither police the world nor be in isolation. To a great extent, this is under the authority of the President as Commander in Chief and the executive official over the State Department.
However, Congress does have an important role in the process. Only Congress has the power to declare war. Many of the powers of Congress revolve around the creation of and maintenance of our armed forces. Congress also has the power of the purse. Congress should not abrogate these powers to the President.
We are at war with terrorists even if some of our leaders refuse to admit it. When at war, the goal is not to degrade the enemy. The goal is to destroy the enemy on the field of battle wherever that field is. We should accomplish that goal.
4) What is the most pressing issue facing the 700,000 or so folks in District 19—economy, drought, farm bill, health care, etc.? Obviously, drought and farm are particular to our region but on national issues, do you believe most regions of the country are aligned on the same issues?
My answer: There are a whole plethora of issues in this campaign—executive branch scandals, over regulation, invasion of illegal aliens, faux homosexual “marriage,” terrorism, murdering our unborn babies, Obamacare, the economy—as in any campaign. The overriding issue, which encompasses many of the specific issues, is the lawlessness of President Obama and his Administration along with the unconstitutional decisions of tyrannical federal court judges. We have an Administration and federal judges who have abandoned the rule of law as established by the Constitution which they have sworn to uphold.
My campaign is emphasizing four goals in this election. The summary of each may be found at http://votevance.blogspot.com/2014/09/vote-vance-official-blog-site-for-write_61.html. Each goal addresses an aspect of the current lawlessness of the executive and judicial branches. Each goal offers a Congressional solution.
Ultimately, this is an ideological conflict. In that sense, they are aligned although it may not be recognized by specific candidates or the voters.
5) What are you doing/will do about the potential to close military installations in the district through BRAC hearings, particularly Dyess AFB?
My answer: I can not envision Dyess being closed or downsized. Texas is an ideal location for such a base. However, given the President’s obsession with transforming the military we must be willing and able to fight for her. My first book—The Black Sword: The Secret U.S. Army in Vietnam—stresses the importance of a strong military. We should be the strongest, most advanced military on the planet—peace through strength. Texas, given her economic strength and strategic location, should actually be able to grow as a part of our military structure.
Nevertheless, it is always a good idea to plan for the unexpected. That would be the responsibility of the city of Abilene and the State of Texas.
The primary responsibility of the federal government is to protect her people from outside forces. I will be an ardent advocate for that throughout my tenure in Congress.
6) Overall, what is the greatest issue facing America?
My answer: We are in an ideological war. Internally, this is probably the most perilous time in our history since the pre-Civil War clash over slavery. One side supports an all powerful national government contrary to the Constitution. The other, which includes me, supports a federal system as established by the Constitution. A system that encourages God established morality, personal liberty and responsibility, respect for the law, and free enterprise. In 1858, Abraham Lincoln gave his famous “A house divided against itself cannot stand” speech. We, as a nation, are at a crossroads. We are a nation divided. I firmly believe we must reverse our present direction and return to the Constitution as written and amended. If we do not, we will cease to be the exceptional nation we have been since our formation.

Impeachment of Federal Courts Judges: A Letter to the Editor

According to ABC radio news, President Obama has decided not to take action on amnesty for illegal aliens (“immigration reform” in Left euphemism) until after the 2014 election. Of course, the reason he decided to wait was because some Democrat Senators up for reelection this year are scared silly that they will lose the election if MORE amnesty is implemented before the election. They think the American voter is TOO STUPID to realize there is no difference whether an illegal act is implemented before or after an election. It is still an illegal act that will do great harm to America!

Yesterday—October 9, 2014—a Texas federal court judge ruled that the Texas Voter ID law was invalid. It is another example of blatant judicial activism. I wrote the follow letter to the editor and sent it to the Abilene Reporter-News and the Lubbock Avalanche-Journal. My original letter was over 300 words. Both of the newspapers require the letter to be 250 words or less. I cut it down to 249 words. Good thing for word count!
I am posting both the original letter and the reduced letter. The original first.
I have heard both Democrat and Republican Congressmen say that the term of office for federal judges is for life. Mark Levin, a lawyer and constitutional scholar, has said the same. It simply is not true.
In Article III, Section 1 of the Constitution, the term of office for federal judges is given: “The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behaviour….” Who determines good behavior? Congress does.
If the House of Representatives questions the behavior of a judge, that body has the constitutional power and authority to impeach that judge. If the judge is impeached, the Senate has the constitutional power and authority to convict that judge and remove him from office.
A federal court judge has just ruled contrary to the Constitution and all common sense that the Texas voter ID law is invalid. A law that was passed by a sovereign State government representing the will of the people was invalidated by one unelected federal court judge for no valid reason other than her own personal opinion. One federal judge vs. an estimate population of over 26 million Texans and that one judge knows best? Not if Texas is indeed sovereign.
Does anyone really believe that the original thirteen States would have ratified the Constitution if they thought one unelected federal court judge could abrogate the will of the people of that State? I am certain they would not have ratified the document.
Congressmen from the sovereign State of Texas have a constitutional responsibility to protect the sovereignty of our State from rogue federal judges who abuse their judicial authority. When the lame duck session of Congress begins, every Texas member of the House of Representatives—Democrat and Republican—should begin the process to impeach this reprehensible judge who has directly annulled our State sovereignty in relation to reasonable and constitutional voter requirements.
The Constitution gives us the authority to protect our sovereignty from unelected federal court judges. We should use it. Unless, of course, we are not sovereign.

“AMENDMENT XVI
Passed by Congress July 2, 1909. Ratified February 3, 1913.
Note: Article I, section 9, of the Constitution was modified by amendment 16.
The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration.”
Congress has used Amendment XVI to impose a federal income tax on both individuals and businesses. Over the years, the tax system has become more and more convoluted and more and more contrary to the intent of the Amendment. The Internal Revenue Service has become politicized and has been used by the current Administration to attack groups, organizations, businesses, and individuals who are opposed to the Administration’s policies and programs. I am proposing a three step process to return the income tax system to the system allowed by the Amendment.
The first step:
Eliminate completely all federal income tax on all types of businesses—sole proprietor, partnership, and corporation. Eliminate the classifications of businesses as for profit and nonprofit. All businesses are the same for federal income tax purposes.
No income, profit, or any other asset of a business will be taxed by the federal government for federal income tax purposes as long as that income, profit, or other business asset is in the control of the business and is used strictly for business purposes. Therefore, businesses will not file a federal income tax return. There will be no credits, no depreciation, no adjustments of any kind including charitable contributions because there is no federal income tax due and payable.
Since there is no federal income tax for businesses, the federal government will not give any grants, credits, money, services, awards, or special considerations of any kind to any business no matter the form. The only time federal money or federal assets are given to any and all businesses is for services rendered by contract as established by Congress by law.
Because businesses are not taxed, businesses as businesses may not donate, contribute, and/or provided services of any kind to any political party, political candidate, and/or political entity at the federal level. What a business can or can not do at the State level is determined by the State. However, in all instances, as far as federal income taxes are concerned, that business income must first be converted into personal income and therefore that personal income will be considered taxable income for individual federal income tax purposes.
These provisions will take affect on January first of the year after the passage of the law unless that time span is less than six months. In which case, the law will take affect in the latter year. For example, if the law is passed and signed by the President (or a veto is overridden) after June 30, 2015, it would become operational on January 1 of 2017. Businesses, which are on a fiscal year, would continue to file and pay taxes through December 31 of the last year of the tax system for businesses. In the above example, the fiscal year would end on December 31, 2016.
A two year adjustment period would exist before step two could take affect. Step two would be readjusting the individual income tax system. No changes could be enacted and put into force during the time period between step one and step two.
