2014 Campaign for Congressional District 19: Goal Two—Replace John Boehner as Speaker of the House

I heard on ABC radio news earlier today that President Obama has decided not to take action on amnesty for illegal aliens (“immigration reformin Left euphemism) until after the 2014 election. Of course, the reason he decided to wait was because some Democrat Senators up for reelection this year are scared silly that they will lose the election if MORE amnesty is implemented before the election. They think the American voter is TOO STUPID to realize there is no difference whether an illegal act is implemented before or after an election. It is still an illegal act that will do great harm to America!

2) Replace John Boehner as Speaker of the House with a solid social, fiscal conservative. There are several candidates that merit consideration including one or two from Texas. The goal must be to replace Speaker Boehner with a strong conservative leader who will provide the leadership that is desperately needed in the House of Representatives.

Tea Party groups became a force in politics in 2010. That year, we elected a number of conservatives unexpectedly winning a number of primaries against establishment Republicans and candidates supported by establishment Republicans. Because of Tea Party groups, the House of Representatives was controlled by Republicans after the election. John Boehner of Ohio, who had been the Republican Minority Leader, was elected by the Republican Party to be Speaker of the House. As Speaker of the House, he has been a major disappointment to social and fiscal conservatives. He has generally refused to use the powers given to Congress and specifically to the House of Representatives to stop or even slow down the lawlessness of President Obama. He has even failed to be an adequate leader of an opposition party! He has been the leader of capitulation and surrender!

His solution to the lawlessness of the President has been to sue the President in federal court. One major, major problem. The Constitution of the United States does not grant to Congress or to the House of Representatives the power or authority to sue the President of the United States.

Article I, Section 8 of the United States Constitution lists the powers of Congress. It does not list to sue the President as a power. The list of powers is long. I will not quote the list. However, here are the starting sentences for powers granted to Congress:

The Congress shall have Power To lay and collect Taxes ….

To borrow Money ….

To regulate Commerce with foreign Nations ….

To establish an uniform Rule of Naturalization ….

To coin Money ….

To provide for the Punishment of counterfeiting ….

To establish Post Offices and post Roads

To promote the Progress of Science and useful Arts ….

To constitute Tribunals inferior to the supreme Court

To define and punish Piracies ….

To declare War ….

To raise and support Armies ….

To provide and maintain a Navy

To make Rules for the Government and Regulation of the land and naval Forces

To provide for calling forth the Militia ….

To provide for organizing, arming, and disciplining, the Militia ….

To exercise exclusive Legislation in all Cases whatsoever, over such District ….

To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers ….

Do you see anything about suing the President? I dont either because Congress and the House of Representatives have no such power! Suing the President of the United States is a meaningless act! It is an attempt to make it look like the House of Representatives is doing something to stop the Presidents lawlessness while actually doing nothing!

However, the Founding Fathers were not unfamiliar with dictatorial executives having just thrown off the shackles of the King of England. Therefore, they put in two important powers for Congress to specifically control a lawless President.

Article I, Section 1 of the United States Constitution

All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.

In other words, Congress, not the President, determines what the laws are on immigration, for example. Congress, not the President and not his bureaucracy, determines how much money will be spent in each area of government and how it will be spent. If the President is being lawless, constitutionally Congress has the ability and duty to cut off the money in that area or any other area so desired and further does not have to ever allocate more money for that area or any other area if so desired! (There are restrictions in relation to payments for services rendered by the President and members of the federal court.) Congress, not the President and not his bureaucracy, has the POWER of the purse!

The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.”

Article I, Section 2, 5 of the United States Constitution

The House of Representatives shall chuse their Speaker and other Officers; and shall have the sole Power of Impeachment.”

The House of Representatives has the power to impeach the Presidentindict the President. Who determines the grounds for impeachment? The House of Representatives does!

And yet, John Boehner has specifically declared that the House of Representatives will not use the power of the purse to stop the Presidents lawlessness! John Boehner has specifically declared that the House will not use the power of impeachment to stop the Presidents lawlessness! He has publicly surrendered and capitulated! He has publicly told the President that NOTHING will be done to stop his lawless actions! He has publicly given up his right to be Speaker of the House!

I pledge that I will work to replace John Boehner as Speaker of the House with a solid social, fiscal conservative. There are several candidates that merit consideration including one or two from Texas. The goal must be to replace Speaker Boehner with a strong conservative leader who will provide the leadership that is desperately needed in the House of Representatives.

I will not vote for John Boehner for Speaker of the House. There is one exception to this. IF the choice is only between John Boehner and any Democrat, then I will vote for John Boehner since he would be better than any Democrat. Constitutionally, the Speaker does not have to be from the majority party although he/she always has been! To vote for John Boehner in this circumstance, my vote has to be the deciding vote.
